USER AGREEMENT OF MINE DESIGNS

This User Agreement has been prepared to be legally binding between you (User) and Mine Designs regarding your utilization of our website, www.minedesigns.online, and your purchases of our products, packages or services. We kindly ask you to read this User Agreement before accessing our services or using any of our services (including purchasing a product, package or service).

"Service": Refers to all sessions, packages, products, trainings, consultations, and other offerings provided by Mine Designs, including but not limited to those listed on the https://www.minedesigns.online/ website. The term "Services" shall be used throughout this Agreement to collectively refer to these components.Every time you access the services and use the services, you are deemed to have accepted these terms. If you do not agree to abide by the terms of the Agreement, you will not be able to use the services.

By registering on our site or logging in via social media networks (Facebook, Instagram), or when you purchase a service, you are considered to have accepted this User Agreement. Additionally, to use the User Agreement and the services on our site, you must be at least 18 years old. If you have not yet reached the age of 18, do not accept the User Agreement and do not use our site. If you accept the User Agreement and/or continue to use our site despite this warning, we would like to inform you that all responsibilities belong to your parents and you. This User Agreement may be updated or changed from time to time by Mine Designs. Since you will be subject to these updates and changes, we recommend that you review the User Agreement periodically.

1. PARTIES
1.1. This User Agreement (hereinafter referred to as the "Agreement") has been established in an electronic environment between the "User" and "Mine Designs" (referred to as "Designer" or "Mine Designs") under the provisions and conditions specified below.
1.2. The "Privacy Policy", "Cookie Policy" and all texts related to GDPR specified in this Agreement are an inseparable part of this Agreement; this Agreement, all terms and conditions of the Agreement, and all its Annexes have been accepted as a whole by the Parties.

2. DESIGNER'S INFORMATION

3. INVOICE INFORMATION

During purchase process, the necessary information for the invoice (name, surname, title, address, National ID Number, Tax ID Number, etc.) will be taken from the user via a form to be created, and the printable view of the invoice will be sent to the user's e-mail address by Mine Designs within 14 days.

4. SUBJECT OF THE AGREEMENT
Mine Designs provides a platform that gives users the opportunity to purchase services through the website www.minedesigns.online. The subject of this Agreement is to regulate access and usage terms and conditions for services, by the User. Additionally, this agreement will determine the Parties' rights and obligations regarding the payment to be made by the User in line with the service, received within the scope of the services on the website.

5. DURATION OF THE AGREEMENT
This Agreement will come into effect with the completion of the registration process by accepting the User Agreement located on our website, www.minedesigns.online, and confirming the email to be sent to the email address notified by the User to Mine Designs, or by purchasing a service, and will remain in effect for the duration of the User's membership and/or use of the service.

6. ARCHITECTURAL and INTERIOR DESIGN CONSULTANCY SERVICES

6.1. Mine Designs, via its online platform on our website, offers Users solution packages, consultations, and shopping possibilities to address their architectural needs.

6.2. All matters related to the content, payment, and return processes of all packages listed and included in the scope of services on the website are detailed on the relevant section of our website that you are interested in.

6.3. The price listed and announced on the site is the sales price of the packages or consultations. The announced price and promise are valid until an update or change is made.

6.4. The User and Mine Designs will conduct a video call individually or as a group at the time and conditions written in the section where the information about the service selected from our website is located.

6.5. The services will last as many days as indicated on our website under the conditions detailed by Mine Designs. In packages that will last two or more days, if the User participates on the first day but does not participate on the second day, Mine Designs will not provide a refund to the User.

7. DESIGN PACKAGES

7.1. Piccolo Package

The Piccolo Interior Design Package fee will be the current price on the website at the date of purchase.
The User and Mine Designs will have a video meeting only once, lasting 30 minutes, on a date both parties approve.
After the video meeting between the parties, an Inspiration Board (Mood Board) will be created.
Before or during the provision of the Service by Mine Designs to the User, the User can request additional design space from Mine Designs. Each requested additional space design will be subject to the additional space fee indicated on the website, and the additional space design date will be determined and notified to the User by Mine Designs. This period determined by Mine Designs cannot exceed 1 (one) month from the date of request.
Additional space requests coming after the service has been completed, will be priced not as additional space, but as a new service and will be offered at the normal package price.
Mine Designs is obligated to deliver the promised services in the relevant package to the User on the date specified.
The Piccolo Design Package must be used within 2 months from the date of purchase. Packages that are not used within 2 months will become invalid and will not be refunded.
The service fees related to the rooms are valid for spaces up to 10 square meters. For situations exceeding 10 square meters, the fee will increase by 5% for each additional square meter.
This package does not include revisions. The designs are final.

7.2 Medio Package

The Medio Interior Design Package fee will be the current price on the website at the date of purchase.
The User and Mine Designs will have video meetings twice, each lasting 30 minutes, on a date both parties approve.
Before or during the provision of the Service by Mine Designs to the User, the User can request additional room design from Mine Designs. Each requested additional room design will be subject to the additional room fee indicated on the website, and the additional room design date will be determined and notified to the User by Mine Designs. This period determined by Mine Designs cannot exceed 1 (one) month from the date of request.
Additional room requests coming after the service has been completed, will be priced not as additional room, but as a new service and will be offered at the normal package price.
Mine Designs is obligated to deliver the promised services in the relevant package to the User on the date specified.
The Medio Design Package must be used within 2 months from the date of purchase. Packages that are not used within 2 months will become invalid and will not be refunded.
The service fees related to the rooms are valid for spaces up to 30 square meters. For situations exceeding 30 square meters, the fee will increase by 5% for each additional square meter.
As the mood boards provided to you are numerous and come with alternatives, this package does not include revisions.

7.3 Grande Package

The Grande Interior Design Package fee will be the current price on the website at the date of purchase.
The User and Mine Designs will have video meetings three times, each lasting 30 minutes, on a date both parties approve.
Upon the User's request, design services for furniture such as a TV unit, console, bookshelf etc. can be provided, up to a maximum of two pieces. However, once the production drawings are delivered to you, Mine Designs has no responsibility related to production.
Before or during the provision of the Service by Mine Designs to the User, the User can request additional room design from Mine Designs. Each requested additional room design will be subject to the additional room fee indicated on the website, and the additional room design date will be determined and notified to the User by Mine Designs. This period determined by Mine Designs cannot exceed 1 (one) month from the date of request.
Additional room requests coming after the service has been completed, will be priced not as additional room, but as a new service and will be offered at the normal package price.
Mine Designs is obligated to deliver the promised services in the relevant package to the User on the date specified.
The Grande Design Package must be used within 2 months from the date of purchase. Packages that are not used within 2 months will become invalid and will not be refunded.
The service fees related to the rooms are valid for spaces up to 30 square meters. For situations exceeding 30 square meters, the fee will increase by 5% for each additional square meter.
The User can request a revision related to the design received. This revision request will be a one-time request and related to a single subject. The revision date will be determined and notified to the User by Mine Designs. This period determined by Mine Designs cannot exceed 1 (one) month from the date of request.
Revisions do not mean a completely new design but cover situations such as color change and material change.
If the area to be designed is a kitchen, it will be specially priced due to the high degree of design difficulty and is not included in the package prices. It is generally priced as a main room fee, not as an additional room. For instance, if you require designs for both a living room and a kitchen, the pricing will generally be calculated as two main rooms. However, if your specific preferences significantly increase the design complexity of the kitchen, additional special pricing may apply.

7.4. Massimo Package

The Massimo Interior Design Package fee will be the current price on the website at the date of purchase.
The User and Mine Designs will have two in-person meetings, each lasting 60 minutes, on a date both parties approve. These meetings are applicable only within the geographical boundaries of Copenhagen and Frederiksberg C.
In addition to the in-person meetings, the User and Mine Designs will also have a total of 2 hours of communication via WhatsApp.
For the Massimo Package, the first meeting must take place at the client's place as Mine Designs needs to take measurements for the services to be provided. If the client is not present at the agreed upon date and time for the meeting, an additional fee of 800 kroner will be charged for the rescheduling and repetition of the meeting.
Before or during the provision of the Service by Mine Designs to the User, the User can request additional room design from Mine Designs. Each requested additional room design will be subject to the additional room fee indicated on the website, and the additional room design date will be determined and notified to the User by Mine Designs. This period determined by Mine Designs cannot exceed 1 (one) month from the date of request.

Please note that all the in-person meetings will strictly adhere to any local safety measures, guidelines, and regulations. The health and safety of the User and the Mine Designs team is of the utmost importance.

8. GENERAL PROVISIONS

8.1. The user acknowledges, declares and guarantees that they have read all the information about the content, sale price, and payment method of the Services on the website and confirms this in an electronic environment.

8.2. Mine Designs commits, declares, and guarantees to provide the service to the User in accordance with the Service content.

8.3. At its discretion, Mine Designs may organize various campaigns for Users on the Site at various times, with the conditions to be determined exclusively by Mine Designs.

8.4. If the User is eligible to benefit from more than one campaign on the same invoice, the campaigns will not be combined, and the User will only be able to benefit from a single campaign. The User accepts, declares, and guarantees that they will not claim any rights in such a situation.

8.5. Mine Designs reserves the right to stop, update, and change the conditions of the campaigns announced on its website or social media accounts at any time. The User must examine each service that they will purchase from the Site before making the purchase (especially the campaign conditions and fee).

8.6. Mine Designs can make changes to https://www.minedesigns.online/ and the documentation without prior notice. Mine Designs may use the contact information provided by the user during registration or site transactions to communicate with the user, and make advertisements and/or notifications.

8.7. A Feedback Form will be sent to the User after the services to be performed. All materials related to the service (lecture notes, certificates, etc.) will be sent to the users who participate by fulfilling the condition of filling out this Feedback Form within 48 hours following the completion of the service.

8.8. After the payment for the purchase of the service is made by the User, Mine Designs, except for force majeure, can withdraw from providing the service to the User at any time without stating any reason, on the condition of refunding the fee. The User accepts this with this agreement.

8.9. All prices stated on the website include VAT according to Danish taxation system.

8.10. Delivery Method and Dates for all Services

Delivery dates may vary depending on the size of the project area and this duration will be clearly stated to the User in the preliminary meeting after the square meters related to the project area are determined.
The average delivery dates are roughly indicated on the website under the relevant service. In case of requests for additional rooms and areas, these durations are reassessed and the final delivery date is notified to the User by Mine Designs.
In the event of the purchase of an additional area or room, a price difference will be additionally requested from the User.
All deliverables related to the design packages, including but not limited to Inspiration Boards (Mood Boards), design plans, revisions, and final designs, will be delivered to the User via email. A Dropbox link containing the necessary files will be provided within the email. The User is responsible for downloading and saving the files from the provided link within a timely manner. Mine Designs is not liable for any loss of data or inability to access the files once the link has been provided to the User.
For the 30-60-90 minute online design sessions and in-person 90-min design session, the delivery of all relevant materials and designs will be made within two business days following the session time. This includes any notes, sketches, concepts, or other deliverables that were discussed or created during the session

9. REFUNDS AND RETURNS
9.1. The specifics for each package, training, course, and consultation, including service hours, are detailed on the https://www.minedesigns.online/ website. If the User is unable to attend at the allocated service time, despite having paid the service fee, the User will not be eligible to request a refund or transfer the fee to another service. It is the User's responsibility to remember their service hours, and Mine Designs is not obliged to provide reminders.

9.2. Mine Designs will determine whether asynchronous course content (video, presentation, document) has been viewed by the User. The User, by accepting these terms, acknowledges that accessing the content constitutes usage. As such, the User forfeits their right to withdrawal following access to the saleable information.

9.3. Should the User choose to relinquish a paid Service, they must submit a written statement of renunciation to mine@minedesigns.online within 72 hours from the date of package purchase. In the absence of a return request within this 72-hour period, the User's Service fee will not be refunded.

9.3.1. In 30-60-90 minute private consultation sessions, if less than 24 hours remains between the appointment setup time and the actual appointment, the User cannot request cancellation and refund. If the User is unable to attend due to unforeseen circumstances, they may request to postpone their session to a later date, for one time only, provided they contact us at least 3 hours before the session.

9.4. During the order creation process for our Piccolo, Medio, Grande, or Massimo design packages, the User will be asked to select their preferred time slot for pre-design meetings. Mine Designs will aim to accommodate the User's chosen time or communicate via email to establish an alternative suitable time if the chosen hour is not feasible.

Once a time has been agreed upon and confirmed, the User will receive an informational email with the date and time details. If the User cannot attend or is late and has not provided at least 24 hours' notice, they will be charged a small rescheduling fee: 350 DKK for Piccolo, Medio, or Grande packages, and 800 DKK for the Massimo package.

9.4.1. If after the pre-meeting, the User requests a refund for the package, in addition to the 3% third-party payment application cut, a fee will be implemented to cover our designers' efforts. This fee will be 499 DKK for the Piccolo, Medio, and Grande packages and 800 DKK for the Massimo package.

9.5. Unless legally classified as 'force majeure', sessions paid for by the User but canceled by Mine Designs can be transferred to a different suitable day, or a refund can be provided upon the User's request. This provision is intended to protect the User against services that cannot be delivered by Mine Designs due to extraordinary circumstances.

9.6. If the User chooses to cancel and requests a refund, a 3% fee will be deducted from the total cost to cover third-party application charges such as Stripe, PayPal etc. This policy does not apply when Mine Designs initiates the session cancellation; it is only applicable when the cancellation is initiated by the User.

9.7. Free informational online meetings offered by Mine Designs are only free of charge if the User attends them. Failure to attend will result in a fee of 150 DKK.

9.8. For in-person sessions, the User is requested to provide a cancellation notice at least 24 hours in advance. If this is not done, Mine Designs is not obliged to offer a refund or reschedule.

9.9. For the purchase of Piccolo, Medio, Grande, or Massimo design packages, the User must utilize the package within 2 months of the pre-meeting date that is part of the package. Failure to utilize the service within this period will result in the cancellation of the service without a refund, except where the waiting period is requested by Mine Designs.

9.10. General Flexibility Clause: While the rules and provisions set forth in this Agreement are applicable to all transactions and interactions with Mine Designs, we recognize that each User's situation may be unique. Therefore, despite any specific rules, Mine Designs will make every reasonable effort to evaluate the User's individual situation fairly and, where feasible and justifiable, may exercise discretion in the application of these provisions. This understanding should not be construed as a waiver of any terms but reflects Mine Designs' commitment to empathy and customer satisfaction.

9.11 Money-Back Guarantee

A. Scope of Guarantee
-Eligible Services: This guarantee applies solely to Online Interior Design Session Services. (Total Transformation 90, Instant Infusion 60, Rapid Refresh 30)
-Non-Transferable: This guarantee is non-transferable and applies only to the original purchaser of the service.
B. Conditions for Eligibility
-Written Complaint: The client must submit a written complaint, outlining specific unmet deliverables or dissatisfaction reasons.
-Valid Reasoning: Dissatisfaction must be based on objective and verifiable failures in delivering the agreed-upon services.
-Exclusions: This guarantee does not apply to dissatisfaction due to subjective taste preferences, misunderstandings not attributable to Mine Designs, or issues outside the agreed-upon scope of work.
Time Frame: Refund requests must be made within 3 days of the session's completion, with no exceptions.

C. Procedure for Requesting a Refund
-Initial Contact: The client must contact Mine Designs through mine@minedesigns.online, providing evidence or specific examples of unmet deliverables.
-Resolution Attempt:
-Opportunity to Rectify: Mine Designs will have the first opportunity to rectify the situation through additional consultation, clarification, correction of mistakes, or other reasonable means.
-Client Cooperation: The client must cooperate with Mine Designs in good faith to allow for the correction of any unmet deliverables.
-Successful Rectification: If Mine Designs successfully rectifies the identified issues to the client's satisfaction, the money-back guarantee will no longer apply, and no refund will be issued.
-Unsuccessful Rectification: If the issues cannot be resolved to the client's satisfaction, the refund process will proceed as described below.
-Refund Assessment: Mine Designs will assess the refund request in a fair and timely manner, with a written response provided within 14 business days.
-Refund Method: Refunds will be processed using the original payment method unless otherwise agreed.

D. Limitations and Restrictions

-One-Time Use: The guarantee may be used once per client per project.
-Partial Refunds: In cases where only a portion of the service was unsatisfactory, Mine Designs may offer a partial refund proportional to the unmet deliverables.
-Third-Party Costs: Mine Designs will not cover any third-party fees, such as transaction fees or currency conversion costs.
-Legal Compliance: Refunds will be issued in compliance with all applicable laws and regulations.

10. WARRANTY

10.1. All content, software, and services obtained from this website are provided "as is", unless specifically stipulated by a separate agreement between Mine Designs and you. They are not subject to any guarantee for suitability for any purpose or from any other perspective.

10.2. Any third-party services purchased through Mine Designs (www.minedesigns.online) or all physical products acquired are under the warranty of the respective party or company.

10.3. Mine Designs may suggest certain companies and brands to you. Mine Designs has no responsibility regarding these companies and brands. Mine Designs does not guarantee the quality of your experience with these companies.

11. ACCESS AND USE OF SERVICES

11.1. The right to access and use the services is personal; it can only be used by the member User and cannot be transferred to any third party or institution/organization.

11.2. This Agreement, all its appendices, all elements, content, pages, membership, and services in Mine Designs are accepted by the User; The User agrees, declares, and undertakes to act in accordance with all these obligations, all existing laws, regulations, morality, and decency.

11.3. All responsibility for the storage, disclosure to third parties, and use of all access information given directly or indirectly by the User to access Mine Designs, such as username, password, is solely the User's responsibility. The User accepts, declares, and undertakes that Mine Designs has no direct or indirect responsibility in this matter, and that Mine Designs will not be demanded for any damages that may be incurred due to any negligence and/or fault in this matter.

11.4. The User accepts and declares that the information they enter, record, and change in Mine Designs is accurate and legally appropriate. All legal and criminal responsibility for all actions performed by the User within Mine Designs belongs to the User. Mine Designs has no responsibility or obligation to control, confirm the accuracy of any entered, recorded, and changed information and content. In the event of a situation that is missing, incorrect, illegal, or harmful to third parties related to the relevant information and content, and if Mine Designs notices this situation, Mine Designs will notify the User to correct the situation or can immediately remove the information or content from the system to remedy the situation. However, the User accepts, declares, and undertakes that Mine Designs has no responsibility in this matter; that they are not directly and/or indirectly liable in any way for any liability, obligation, damage, loss, expense, and cost that may arise in any real and/or legal person, state or public authorities, law, all responsibility belongs solely to the User, and Mine Designs has a recourse right against the User in this matter.

11.5. Mine Designs, the owners, partners, managers, and employees of Mine Designs are not responsible for the services provided and content published by third parties, including users, on the minedsigns.online website. The assurance of the accuracy and legality of information, content, visual and audio data provided and published by any third party is entirely the responsibility of the persons performing these actions.

11.6. The User is the owner of all information and content that they have provided, entered, recorded, or changed in Mine Designs; they are aware that they can delete this from Mine Designs at any time or ensure its deletion by request.

11.7. The User accepts, declares, and undertakes not to act or act against the law, morality, and decency while using Mine Designs, not to disturb other users, not to act in a way that restricts or restricts their use, not to partially or completely block, restrict, disrupt, copy, reproduce the Mine Designs systems, databases, infrastructures, operations, software, not to engage in spam, unsolicited or mass electronic communication or chain email sending, not to use or allow the use of viruses or other harmful software or technologies.

11.8. If the User does not comply with these obligations, Mine Designs reserves the right to temporarily or permanently terminate the User's www.minedesigns.online access and/or membership at its discretion.

11.9. Users accept, declare, and undertake that in any legal prosecution, investigation, or case directed to Mine Designs in relation to the relations they enter into with Service Providers, product and/or service purchases or transactions on the site, Mine Designs is not responsible and will provide all necessary information and documents that Mine Designs may request for its defense as soon as possible.

11.10. Mine Designs has the right to close the services offered on the Website for access, delete, change and remove at any time and without any notification to the User. There is no right to make any request from Mine Designs for these reasons.

11.11. During the use of https://www.minedesigns.online/, the User agrees to keep the confidential information learned about https://www.minedesigns.online/, the system, third-party right holders on works including content, environment, or platform suppliers of Mine Designs, or Mine Designs, which is beyond the purposes of web use of https://www.minedesigns.online/, not to disclose or reveal it partially or completely to third parties directly or indirectly in any way.

11.12. If the User does not comply with their commitments and obligations within the scope of this article, they will be responsible for compensating the amount of compensation requested from Mine Designs due to third-party claims and damages suffered by third parties, and all other costs including but not limited to court costs and attorney fees.

12. PROTECTION OF PERSONAL DATA and PRIVACY

12.1. As elaborated in detail in the Privacy Policy on the Website, under the scope of GDPR, information such as name, surname, email address, identification number, demographic data, interior design information related to users' spaces, photos and videos, users' comments, messages, financial data, etc., belonging to the User, may be defined as personal data. These data are used to provide services on the website, improve consulting services, resolve system issues, carry out payment transactions, conduct marketing activities about provided services, update User's information, manage and maintain memberships, and execute any and all contracts such as Consultancy Service Contract, Course Contract established between the Designer and the User.

Mine Designs, its authorized employees, business partners, and when necessary, third parties and/or public institutions may indefinitely/temporarily record, store in written/magnetic archives, use, update, share, transfer, and process in other ways all the required information within the scope of services provided by Mine Designs.

In this context, the User accepts that their personal data can be processed within the scope of the purpose.

13. INTERRUPTION AND TERMINATION OF SERVICES

Users' access to and use of the services may be interrupted entirely at the discretion of Mine Designs due to periodic maintenance or update operations of the website, maintenance or repair, and without limitation to these. Mine Designs can suspend or terminate any part of the services and/or availability of provided features at any time, at its own discretion, without prior notice.

14. USERNAME AND PASSWORD SECURITY

When the User becomes a member of Mine Designs, they will set a username and password. The User is solely responsible for the protection and confidentiality of the User Account and password that can be accessed with this username and password. The responsibility for all transactions and activities carried out under the User Account also belongs only to the User. If the User thinks that their account is no longer secure and has a valid reason for this, they are obliged to notify Mine Designs immediately.

15. LIMITATION OF LIABILITY

15.1. Mine Designs does not guarantee the scientific or interpretive accuracy of the information contained on https://www.minedesigns.online/. Mine Designs is not responsible if https://www.minedesigns.online/ does not directly serve the user's purpose. Mine Designs is not responsible for any damages, including but not limited to material and/or moral and/or direct and/or indirect damages that may occur due to unexpected technological developments.

15.2. Users accept, declare and commit that they are solely responsible for the decisions they make as a result of Mine Designs services. The Services provide a platform for Users to gain information and solely Users are responsible for the selection of any product and/or service offered by third parties including the Service Provider (Architect, Designer), decisions made by Users based on this, and the consequences of these decisions.

15.3. During the Project Management sessions, Mine Designs assumes the role of coordinating and providing information remotely or, when necessary, on-site in the Copenhagen area. Notwithstanding, Mine Designs cannot be held liable for the actions of construction teams or individual contractors carrying out work on a renovation project.

Even though Mine Designs may refer these teams or individual contractors, it cannot be held responsible for their behavior or the quality of their workmanship. Mine Designs is there to manage each stage from coordination with implementers to budget control, aiming to make the renovation process more enjoyable and less stressful for the user.

However, separate contracts are advised to be drawn up between the User and the contractors undertaking the work and these separate contracts should protect the user's rights independently from the services provided by Mine Designs.

Please note, while Mine Designs assists in the coordination and endeavors to mitigate potential issues during the renovation process, it is not liable for any unforeseen complications, delays, cost overruns, or disputes that may arise between the user and contractors.

15.3.1. Mine Designs shall make every reasonable effort to provide accurate and appropriate information to contractors. However, in the unlikely event that incorrect information is provided, Mine Designs shall be responsible for rectifying such misinformation to the best of its ability. It should be noted, though, that any consequent delays, cost overruns, or disputes that may arise due to such misinformation are limited to the direct results of the misinformation provided and not any indirect or consequential damages.

15.3.2. In cases where Mine Designs is found to be at fault due to the provision of incorrect information, Mine Designs' liability shall be strictly limited to the fee paid by the user for the particular service in which the error occurred. This is on the condition that the error does not result from intentional misconduct or gross negligence on part of Mine Designs.

15.3.3. On the other hand, the user also has a responsibility to provide Mine Designs with accurate and timely information regarding the project. If any delays, additional costs, or other issues arise as a result of incorrect or incomplete information provided by the user, Mine Designs will not be held responsible. The user shall bear any such additional costs.

15.3.4. In all cases, Mine Designs shall not be held responsible for the quality or suitability of work done by the contractors or the materials used. Mine Designs' role is limited to coordination, project management, and providing advice. The user is responsible for the final approval of all work done by the contractors and for any disputes arising from the work quality or materials used.

It is strongly recommended that all users secure comprehensive insurance coverage for their renovation projects to protect against unforeseen incidents or costs. Mine Designs may provide advice in this area but it does not provide insurance coverage or guarantees against damages, cost overruns, or contractor disputes.

16. USER CONTENT

16.1. Emails, messages, reviews, photos, videos, pictures, folders, data, text and other types of work of the Users will be collectively referred to as "User Content" in this Agreement. Certain features of the Service may allow the publication of User Content. In User Content to be shared on Mine Designs, the copyright and other ownership rights belonging to the User are owned solely by the User sharing. By sending User Content to Mine Designs, the User grants the rights to host, store, transfer, and publish User Content, without any limitation, worldwide, free and without being subject to license. Mine Designs has the right to use User Content, partially or entirely, in any media format and through any media channel (currently known or to be developed in the future).

17. INTELLECTUAL PROPERTY

17.1. All assets, including but not limited to names, graphics, videos, logos, page headers, service names located on the Mine Designs website and any type of asset belonging to the owners of Mine Designs, all kinds of property, intellectual property, and copyright belong to Mine Designs; these are the trademarks of Mine Designs around the world (all together "Registered Trademarks"). Mine Designs assets cannot be used without prior written permission.

17.2. The name, title, trademark, brand, logo, and service marks of third parties contained in the Services belong to the relevant third parties and cannot be used without permission.

17.3. The copyright/license rights of the information, advice, data, software, and content, line art, icons, and presentations that can be downloaded/obtained from or included in the services, including without limitation all texts, graphics, charts, images, photos, pictures, videos, and other content (collectively "Content") belong to Mine Designs. None of these Contents can be modified, copied, reproduced, license applications cannot be made related to them, they cannot be converted into another license, and they cannot be used without permission. In case of contrary behavior, all legal rights of Mine Designs are reserved.

17.4. All software used on or within the services belongs to Mine Designs; they are protected by international copyright laws.

18. THIRD-PARTY LINKS

Mine Designs may provide 'links' to other websites, portals, files, or content owned and operated by third-party vendors, providers, and other third parties that are not under Mine Designs' control. These 'links' may be provided by Mine Designs for the convenience of reference or to support the person operating the website, or they may be given for the purpose of earning additional income for Mine Designs.

18.1. Disclaimer: Mine Designs does not endorse, warrant, or make any representations regarding the content, products, or services on linked third-party websites. Mine Designs has no responsibility for the portals, websites, files, and content accessed via 'links' on the site, or for the services or products offered from the websites or their content. Use of any such linked website is at the user's own risk.

18.2. Indemnification: Users agree to indemnify and hold harmless Mine Designs, its affiliates, directors, officers, employees, agents, and licensors from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, arising from or related to the use of third-party links accessed through the Mine Designs website, including but not limited to any violation of third-party rights or applicable laws.

They do not carry any form of declaration or warranty for the website or the information it contains. Users are encouraged to review the terms and conditions and privacy policies of these third-party sites before engaging in any activity on them.

19. THIRD-PARTY DESIGNERS

Mine Designs may work with third-party designers not under its own control and lease its platform for them to provide their services. Mine Designs can only be held responsible for the services provided by Mine Designs and its direct team. Mine Designs is not responsible for the services of third-party designers who lease the Mine Designs platform to provide services and are listed under the "Designers" tab. Each third-party designer has a user agreement specific to the service they provide. The user is asked to read and approve this agreement when purchasing the relevant service from the third-party designer. The user is obliged to read the agreement offered by the third-party designer and, by buying service or product from third-party designers, preemptively accepts that Mine Designs has no responsibility other than being a platform provider.

20. INVALIDITY

If any provision of the Agreement is found to be contrary to the law, invalid and/or void, and therefore unenforceable, the Parties agree to make any changes possible to validate it. If that is not possible, they agree that the remaining provisions, which are not affected by this, will be valid.

21. STATEMENT AND COMMITMENT

Within the scope of services provided by Mine Designs, Mine Designs system makes no explicit or implicit statement and/or commitment regarding the accuracy, completeness, suitability for a particular purpose of the information on the website; continuous or uninterrupted access to the system, website and/or mobile application. Mine Designs does not guarantee that its website and mobile application do not contain viruses or other harmful software, that there will be no error, fault, deficiency, defect and/or access problems, or that they will be fit for a specific purpose. All risks arising from the use of Mine Designs' website are borne by the User. The risk and responsibility of all damages, including loss of service or data, resulting from their use is the User's responsibility.

22. INTEGRITY

The integrity of this Agreement is not compromised, and the Agreement does not lose its validity, due to the removal, alteration, invalidation of any clause, or additions to the Agreement.

23. NOTIFICATIONS

All notifications to be made within the scope of this Agreement between the Parties can be made via email, registered mail or notary. If the User does not notify or update the changes in the address or email address they reported while registering, notifications sent to the existing email address or address will bear all the provisions and consequences of a valid notification.

24. FORCE MAJEURE

If the obligations arising from this Agreement cannot be fulfilled by the Parties due to causes beyond the Parties' control, such as natural disasters, fire, explosions, civil wars, wars, riots, public movements, declaration of mobilization, strikes, lockouts, and epidemic diseases, infrastructure or internet failures, power cuts, the Parties are not responsible for these. During this period, the rights and obligations arising from this Agreement are suspended for the Parties.

25. TERMINATION

Both the User and Mine Designs have the right to terminate this Agreement at any time they wish. The ongoing obligations of the Parties will not be affected by this termination.

26. APPLICABLE LAW AND COMPETENT COURT

This Agreement shall be governed by and construed in accordance with the laws of Denmark. All disputes, controversies or claims arising out of or relating to this Agreement shall be resolved through amicable negotiations between the Parties. If a resolution cannot be reached, such disputes, controversies or claims shall be settled by the competent courts of Denmark, specifically the court in the district where Mine Designs is located, which shall have exclusive jurisdiction.

27. EVIDENCE AGREEMENT

The parties accept, declare and undertake that in the disputes that may arise related to this Agreement, the books and records of the parties, as well as computer records, WhatsApp messages, email, fax, telephone, and voice message records will be considered valid and binding evidence.

28. REPRESENTATION

The Parties agree, declare, and commit that this Agreement will not create any partnership, joint venture, representation, agency, or other types of joint enterprises between them and shall not be construed as such. They acknowledge that they do not have the authority to perform any action or transaction that binds the other Party or places the other Party under obligation or debt.

The totality of this Agreement, composed of twenty-eight (28) main clauses, upon being read and fully understood by the User, will be confirmed electronically and will come into effect the moment it is confirmed.
